Mobile Messaging Terms of Service

These Mobile Messaging Terms of Service (“SMS Terms”) govern your participation in Spectra Behavioral Health, LLC’s (“Spectra,” “we,” “us,” or “our”) text messaging program.

By providing your mobile telephone number and separately consenting to receive text messages from Spectra, you agree to these SMS Terms.

If you do not agree to these SMS Terms, please do not opt in to receive text messages from Spectra.

1. Program Name

2. Program Description

The Spectra Behavioral Health SMS Messaging Program allows clients, parents, guardians, caregivers, and other authorized individuals to receive text messages from Spectra related to services and communications they have requested or authorized.

  • Messages may include, as applicable:

  • Appointment reminders and scheduling communications;

  • Changes or updates related to appointments or services;

  • Responses to questions or requests;

  • Intake or service-related notifications;

  • Administrative communications;

  • Information regarding requested services; and

  • Other service-related communications for which you have provided consent.

The specific messages you receive will depend on your relationship with Spectra, the services you request or receive, and the communications for which you have opted in.

3. Consent to Receive Text Messages

By voluntarily providing your mobile telephone number and affirmatively opting in to the Spectra Behavioral Health SMS Messaging Program, you consent to receive text messages from Spectra at the mobile number you provided.

Your consent is specific to the Spectra Behavioral Health SMS Messaging Program and does not constitute consent to receive marketing messages from unrelated third parties.

Consent to receive text messages is not a condition of purchasing services or receiving care from Spectra.

You may withdraw your consent at any time as described below.

4. Message Frequency

Message frequency varies based on your appointments, service needs, requests, and interactions with Spectra.

You may receive more or fewer messages depending on the circumstances and the types of communications you have requested.

5. Message and Data Rates

Message and data rates may apply.

Your mobile carrier may charge you for text messages or data according to the terms of your mobile service plan. Spectra is not responsible for these charges.

6. How to Opt Out

You may stop receiving recurring text messages from Spectra at any time.

To opt out, reply:

STOP

to the Spectra number from which you are receiving messages.

After you send STOP, you will receive a confirmation message, where applicable, and Spectra will discontinue recurring SMS communications associated with the applicable messaging program.

You may also contact Spectra directly to request that SMS communications be discontinued.

Opting out of SMS communications does not necessarily end other communications from Spectra that are necessary to provide services you have requested or that are otherwise permitted or required by law.

For help with Spectra’s SMS messaging program, reply:

HELP

to the Spectra number from which you are receiving messages.

8. Re-Opting In

If you have previously opted out and later wish to receive SMS communications from Spectra again, you may provide new consent through an available Spectra SMS opt-in process.

A previous opt-out will remain in effect until you provide new consent.

9. Supported Devices and Carriers

The Spectra Behavioral Health SMS Messaging Program is intended for compatible mobile devices and participating wireless carriers.

Spectra does not guarantee that SMS messages will be available on every device, through every wireless carrier, or in every geographic area.

Carriers are not liable for delayed or undelivered messages.

10. Privacy

Spectra’s collection and use of information associated with the SMS Messaging Program is described in our Messaging Privacy Policy.

Spectra does not sell or share your mobile telephone number, SMS opt-in information, or SMS consent information with third parties or affiliates for their own marketing or promotional purposes.

11. Changes to the SMS Program

Spectra may modify, suspend, or discontinue the SMS Messaging Program or any portion of the program at any time, including when necessary to comply with applicable law, regulatory requirements, wireless carrier requirements, or changes to our services.

Spectra may also update these SMS Terms from time to time.

When material changes are made, we may provide notice through an appropriate communication method.

Your continued participation in the SMS Messaging Program after changes become effective constitutes acceptance of the updated SMS Terms, to the extent permitted by applicable law.

12. Appropriate Use

You agree not to use Spectra’s SMS messaging services in an unlawful, abusive, fraudulent, or otherwise unauthorized manner.

Spectra may discontinue SMS communications to a recipient if we reasonably believe the messaging service is being misused, the recipient has not provided valid consent, or continued messaging could violate applicable law, regulations, wireless carrier requirements, or Spectra’s policies.

13. No Guarantee of Message Delivery

SMS messaging relies on telecommunications networks and third-party wireless carriers. Spectra cannot guarantee that every message will be delivered, delivered immediately, or delivered without interruption.

Carriers are not liable for delayed or undelivered messages.

14. Applicable Law

These SMS Terms are governed by applicable federal and state laws and regulations, including applicable telecommunications and consumer-protection requirements.

Nothing in these SMS Terms is intended to limit any rights or protections that cannot legally be waived.
